Family Law consists of all matters between yourself and another individual which the State of Florida has some vested interest in. This included divorce, paternity, pre-nuptial agreements, wills, child support, custody, modifications and juvenile dependency cases. All of these cases have multiple facets for your attorney to be aware of because not only must I be aware of what the state of law is, but you need to educate me about the dynamics of the relationships involved. Quite frankly, although you may have a legal right to do something to someone, if we are not careful, it will have permanent ramifications over time. In custody cases for instance, even if you win custody, you still have to deal with the other parent until that child becomes eighteen and even after that point, the reality is that you will have to deal with the other parent and your adult child for graduations, weddings and grandchildren. Therefore, we want to be careful about what we do and say about litigation and as a general rule, if it isn’t nice, don’t say it.

Like the criminal system, typically, a family law case begins with the filing of a petition or complaint for whatever relief you are asking the court for. This is followed by a mandatory discovery and possibly a parenting class, various motions to establish support and contact during the case and then finally, mediation followed by a trial, or other resolution of your case. As always, if the parties agree to a specific result, it costs far less in attorney’s fees and ultimately far less in emotional costs. Because of the wide spectrums of individual situations, this synopsis on family law cannot go into any detail as to specifics, but please note we provide a free initial consultation so you can determine what rights you do have as well as determine if I am a suitable professional for you to work with.
