Learn how bankruptcy can resolve so-called Merchant Cash Advance loans that can paralyze a business's cash flow, SBA loans including EIDL, IRS and Department of Revenue claims, mortgage foreclosures including loan modifications, credit card debt, judgments, and federal student loans.
Merchant Cash Advance
MCAs are marketed as a quick fix — fast money, no collateral, minimal paperwork. For a business owner under pressure, it feels like salvation.
But the reality? An MCA is often a wolf in sheep’s clothing that punches you in the face and takes your goodies — potentially your business’s assets and future. Many businesses are unable to keep up with the high payments and find themselves trapped. MCAs can send letters to your customers and turn off your cash flow. They can also send restraint notices to credit card companies. This can make it impossible to keep up with basic expenses, including payroll for valued employees.
Filing bankruptcy can free up that cash flow. MCAs must retract restraint letters after your business files for bankruptcy.
Small Business Administration Loans
As the COVID EIDL Hardship Accommodation Plan (HAP), ends there no direct long-term solutions from SBA for small businesses. Bankruptcy might be the best solution for you or your business.
The type of bankruptcy that may be the best for you depends on whether your business is still operating, whether you guaranteed the loan personally or as a business entity, and whether your business could remain viable if debts are restructured.
Federal Student Loans
For the past 25 years, discharging a student loan through bankruptcy has been nearly impossible. That has changed drastically regarding federal student loans in the past few years. Now, the Department of Justice and the Department of Education will work with debtors and consent to discharge in certain cases if a sworn attestation form shows that there is no money left over after reasonable and necessary expenses to pay the student loans, along with other factors such as how old the loans are, good faith attempts to pay the loans, and future inability to pay the loans.
